강좌소개

The US Congress enacted the Foreign Corrupt Practices Act (FCPA) in 1977 in response to findings that many American companies had been making hundreds of millions of dollars of questionable payments to foreign government officials, politicians and political parties. The purposes of this Act are to halt the bribery of foreign officials, restore public confidence in the integrity of the American business system, and promote stronger and more reliable foreign legal regimes. The US Department of Justice (DOJ) and the Securities and Exchange Commission (SEC) share responsibility for enforcing the FCPA through proper FCPA training. The head of the DOJ's Criminal Division recently described his agency's focus on FCPA enforcement as "stronger than it's ever been — and getting stronger." He warned executives and employees that "we seek to hold you personally accountable for FCPA violations." Soon afterwards, the DOJ and SEC released a "Resource Guide." The Guide provides detailed information about the US Government's approach to the FCPA and its enforcement priorities. This FCPA training course is based on this Resource Guide.

This course explains the core principles of US anti-corruption law. It is intended to help employees understand the importance of FCPA compliance and recognize and respond appropriately to “red flags” -- situations that present a risk of FCPA violations. The course is based on the FCPA Resource Guide released in November 2012 by the DOJ and SEC.
